Members of the Eagle Pass Independent School District Board of Trustees could be contemplating possible legal action against at least two local news organizations due to the alleged publication of false information by these media outlets. 

The allegations of publicizing false information regarding some of the EPISD Board Members is stemming from information that was publicized in recent months, specifically during the past School District election cycle.   

This information - according to sources close to the EPISD Board and Administration - was derogatorily false and came with unwarranted attacks on some of the school board members.  

The issue was brought up at the EPISD Board of Trustees meeting held on Tuesday, February 12, 2019, and discussed in executive session. 

During the meeting the school board went into closed session: pursuant to Sections 551.071, 551.072, 551.074, 551.082, 551.083, and 551.084 Texas Government Code.  

Once back in open session, the EPISD School Board took no action on the matter, but it is being carefully looked at as it is believed some of the Board Members are looking at what legal actions can be taken, if any. 

This issue is certainly something to keep an eye on as media organizations have certain rights under the First Amendment of the U.S. Constitution , but also have a responsibility to report information with accuracy under Press Law and Ethics.   

Locally, in the past, some media outlets have been sued for printing and publicizing false and inaccurate information. 

In two of those instances, the media outlets were found to be in the wrong and lost the lawsuits in court. Another was settled with the affected party by a mediator.
